CommandBay Business

Terms and Conditions

Draft for owner and lawyer review · Version 2026-09-18 · Not yet approved for public launch

1. Service and operator

These draft terms cover CommandBay Business, its guided checklist, saved plans and downloads. The operator is Kate Marie Wallwork trading as CommandBay, ABN 31 818 697 069. For customer support, privacy enquiries and deletion requests, contact commandbay@hotmail.com. These pages are being reviewed and do not represent a completed paid-service contract.

2. Who this version is for

This service is designed for adults aged 18 or older starting an Australian business. Use it for your own plan or with permission from the person whose plan you are helping prepare. Do not submit children’s personal information during this test.

3. Education and your decisions

The app organises your answers and links to information. It does not establish a company, register a business, apply for licences, lodge tax documents, provide financial products, or check that your business is compliant. It does not replace advice from an appropriately qualified accountant, tax agent, lawyer or industry adviser.

Rules, fees and eligibility can change. Check the official source and your circumstances before acting. Estimates and calculator totals cover selected items only and are not a complete operating budget. A completed checklist or generated plan is not government approval, a loan assessment or a guarantee of income.

4. AI information

The AI section explains considerations for using other AI tools. This app currently assembles your answers without sending them to a generative-AI service. Check third-party outputs, permissions and applicable rules before using AI in your business. A future AI feature would require updated disclosures before its use.

5. Your answers and permitted use

You keep your rights in the original material you provide. You permit us and our service providers to process it only as needed to supply, secure and support the service, as described in the Privacy Policy. This permission does not allow us to sell your plan or use it to train generative AI.

You may use, edit and share your downloaded plan for your business, including with advisers. CommandBay branding, application code and educational material remain subject to their owners’ rights and any applicable third-party licences. The service does not transfer ownership of the application to you.

Do not access someone else’s plan without permission, attempt to bypass access controls, upload unlawful material or malicious files, misuse verification emails, or use the service to infringe other people’s rights.

6. Saving and account security

Email saving is optional and starts only after verification and choosing a plan. Protect your email account and codes. Browser drafts stay on that browser profile; disconnecting does not erase them. Use backups and check the saved status before leaving. On another device, open your saved plan rather than replace it with an empty draft.

Availability and delivery of emails can be interrupted. We do not promise uninterrupted access, permanent storage or recovery of every lost draft. This does not limit rights that the law gives you. See the Privacy Policy for current storage and deletion limitations.

7. Price and future purchases

The preview is free to test. Stripe test checkout is being integrated to test a one-time A$3 business-plan unlock. Where test checkout is enabled, it uses test payment details and does not move real money. Do not enter real card details in test checkout. This is not a subscription, and workshop-software subscriptions are a separate service.

Before paid checkout is activated, we must clearly display the final total, tax treatment, exact product, access duration and re-download rights, delivery method and support/refund process. Any purchase must require an explicit customer action. Testing users must not be charged retrospectively or enrolled in recurring payments.

8. Consumer rights and problems

Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees. We do not impose a blanket “no refunds” policy or claim you waive statutory rights by downloading a document.

If a service or future purchase has a problem, contact support with a description and, if relevant, the purchase reference. Appropriate remedies depend on the problem and applicable law and may include fixing the issue, resupply or a refund. See ACCC consumer rights information.

9. External services and links

Government and other third-party sites operate independently. Their terms and fees may apply when you use them. Linking does not imply endorsement or that CommandBay completes the linked task for you. We remain responsible for our own obligations.

10. Changes, stopping use and disputes

You may stop using the service at any time and request information about removing saved data. Access may need to be restricted to respond to misuse or a security threat. Any restrictions should be proportionate, with an explanation and opportunity to resolve the issue where practicable and lawful.

Material service or term changes should be notified before they apply. Changes must not retrospectively remove paid entitlements or statutory rights. These draft terms nominate Queensland, Australia as the governing law, together with applicable Commonwealth law. This does not remove mandatory rights available where you live or prevent proceedings in a court or tribunal that has jurisdiction. You can raise concerns with support; this does not remove your right to seek independent advice or contact a regulator. Queensland consumers can also find complaint assistance through the Queensland Office of Fair Trading.
